Od vsega tega postajam že utrujen.

Torej zdi se, da namerava ministrski svet EU postaviti težko izbojevano
bitko v evropskem parlamentu ob prvem branju direktive o progamskih
patentih spet na ničto točko in v najboljšem primeru se bo vse začelo
znova.

Kam je šlo ločevanje oblasti med zakonodajno, izvršno in sodno? V kakšno
evropo gremo?

The Council of the Ministers of the European Union, currently presided
by Ireland, is circulating a Working Paper with counter-proposals to the
European Parliaments Amendment. In contrast to the European Parliament's
version, the Council version allows unlimited patentability and patent
enforcability. Under the Council version, Amazon One Click shopping is
without a iota of doubt a patentable invention, publication of programs
on a server already constitutes an infringment, and use of patented file
formats for the purpose of interoperation is not allowed. Since the
decision process of the Council is secretive, it is not known who is
backing this proposal in the name of which government, but it is well
known that the responsible workgroup consists of officials from national
patent offices and people close to this group who also, in personal
union, sit on the administrative council of the European Patent Office. 



Details
The Council's working draft removes everything from the Parliament's
amendments that limits patentability, including: 
     1. All definitions of "technical", "invention" and "industrial" are
        removed, and yet patentability is limited by nothing but these
        terms.
     2. Freedom of publication is removed from Art 5, instead
        information goods become directly claimable, so that internet
        service providers can be sued for allowing publication of
        independently developped programs on their server. (see Program

     3. Art 6a (freedom of interoperation) is removed. This way
        Microsoft receives green light for its new licensing program on
        file formats, and large software and telecommunication companies
        can charge fees for the use of the next generation of Internet
        standards.
     4. A few cosmetic amendments by EPO-friendly MEPs such as Arlene
        McCarthy and Joachim Wuermeling are admitted into the draft.
        Among these are amendments which were rejected by the European
        Parliament in the plenary vote.

onemoglosti.

torej ... v italiji je sodišče v konkretnem primeru odločilo, da so
