Danes je v EU parlamentu potekalo prvo branje in potrditev nove
direktive o softwarskih patentih.
Kljub temu, da je bila direktiva sprejeta, je tistim, ki so se borili
proti njej uspelo spraviti skozi branje takšne amandmaje, da so jo v
bistvu skoraj postavili na glavo.
To jim je uspelo tudi tako, da so nekateri cel zadnji teden preživeli v
Bruslju in lobirali od poslanca do poslanca.
Debate so bile burne, ljudje sploh niso spali in na koncu je bil uspeh
tu. Morda najbolj zanimive in hkrati najbolj zastrašujoče pa so izjave
nekaterih poslancev v zvezi s prepričevanjem. Namreč, da se počutijo
nadlegovane, saj jih je namesto običajnih industrijskih lobistov
nadlegovalo ogromno 'navadnih' posameznikov in, da se to sploh ne
spodobi. Hmmm....
Mislim, da gre vsem, ki so se tako zelo angažirali pri tej odločitvi
resnično za čestitat. Posbno FFIIju in ostalim! Vendar ne pozabiti, da
ej bilo to šele prvo branje (sicer je to odločilno za vsebino, a
vseeno)!

In its plenary vote on 23rd of September, the European Parliament
approved the proposed directive on "patentability of
computer-implemented inventions" with amendments that clearly restate
the non-patentability of programming and business logic, and uphold
freedom of publication and interoperation. The day before, EC
Commissioner Bolkestein had threatened that the Commission and the
Council would withdraw the directive proposal and hand the questions
back to the national patent administrators on the board of the European
Patent Office (EPO), should the Parliament vote for the amendments which
it supported today. "It remains to be seen, whether the European
Commission is committed to "harmonisation and clarification" or only to
patent owner interests", says Hartmut Pilch of FFII.
